Forked From: New boots.. Returning items
:) Forked from:
5689670) They are giving me a new pair!! Had to state that under the sales of goods act 1979 all goods should be of satisfactory quality and then they gave in and said they'd exchange!! whoop!! :hop: :hop:
technically under the same act once a customer has worn items out, they have accepted that the item is of satisfactory quality.
sorry but this has annoyed me slightly.
i *may* have said this before but i work in retail, have done for the last 7 years and the amount of customers that demand to see me telling me they know their rights when they clearly don't has become a daft amount.
i know we've all had a few problems (Office shoes! pointing no fingers!) and with it being sale time i bet at least a few of us have picked up an item, got it to the till and it's different price etc etc
so! just a few important pieces:
- If an items has a fault, it is reasonable to be offered a repair but that doesn't mean your not still entitled to a full refund!
- If the item cannot be replaced or repaired then you are entitled to a refund. You don't have to take gift vouchers or credit notes!!!
- You have no rights if the item simply doesn’t fit, you change your mind or if you've picked the wrong size so just make sure before you wear it
- Proof of purchase:if you don't have you reciept the store can also accept a credit card or bank statement. You don't just need a reciept! don't be fobbed off!
- If the fault is pointed out to you, you can't get a refund on the item unless it develops a different fault. If a different fault appears you can still get a refund!
- Stores don't have to give a refund on an item thats of good quality but most places do as a gesture of goodwill.
- Buttons and heel tips will wear down/fall off, doesn't make it faulty but it shouldn't happen within the first wear. Easily repairable but you don't have to accept a repair job
and they may take the item from you to inspect it (by this i mean, take it in the back or just somewhere away from where you are, only because it is must easier to quickly inspect an item this way)
If your asking for the SA's name, don't be surprised if they don't give you their full name. They don't have to and to be honest it would be pretty easy to figure out who served you just by a first name.
If an item is say priced at £15 and once you get to the till it scans at say £30, the store doesn't legally have to sell you it at that price. The store can "remove the item from sale due to a mis-price" but to do this they must at that point get every single one of that item and remove them from the shop floor to be repriced.
Now not a lot of stores actually go to the hassle of doing this so most will give it to you at the lower price as a "gesture of goodwill"
One last thing, you will get on a lot better when returning something if you keep your cool. Don't start shouting at them, they don't deserve a verbal! (and you could get removed by security!)
Just some things that have cropped up in my store over the last few weeks and i suppose it's just a little vent on my part cos i'm a bit sick of people shouting at me, i work in retail, i'm not stupid i know your rights too!
hope it helps and i'll just jump off my soapbox now, sorry!
Answer:
thanks PD, that makes for interesting reading.
I still think that lil tink's boots do count as faulty in my mind, even if she's worn them out of the house. Sometimes difference in colour can't be seen unless in daylight, and the first time that happens is usually when worn outside. I don't inspect everything I buy in daylight before I wear it because I assume it won't be faulty (maybe I'm being overly optimistic!).
Anyway, I know that's not the point of this thread, and I agree with you about not losing your cool when asking for a refund. When I worked in retail, anyone that started to get aggressive would bring out the stubborn streak in me and make me more determined to not give them a refund, (unless of course, I thought they had a genuine complaint).

i'm like that too! start getting agressive and i give you nothing! (unless it's a justified complaint)
at 5f3ish it's blooming intimidating, i love my 6ft5 built-like-a-tank-security guard! :mwahaha:
i just think that not as many people know their rights as well as they should and i think some people get screwed over and fobbed off with credit notes when they're entitled to full refunds! hurrah!
Answer:
I didn't mean for people to go in shouting the odds if they didn't know their rights, I checked with trading standards before I went in and didn't shout and stomp my feet which I think helped.
I do honestly believe that the boots were not exactly faulty but they weren't of a satisfactory standard which is what I said to them, I never wanted a refund as i do :throb: them.
This is from the trading standards website:
The Sale of Goods Act 1979 (as amended) says that goods should be as follows:
Of satisfactory quality.
This means the goods must meet the standards that any reasonable person would expect, taking into account the description, the price and all other relevant information. In some circumstances, the retailer may be liable for any statement made by the manufacturer about the goods.
Satisfactory quality includes the appearance and finish of the goods, their safety and durability and whether they are free from defects (including minor faults)
Fit for the purpose
that goods of this type are generally sold. They must also be fit for any specific or particular purpose made known to the seller at the time of the agreement.
As described
- goods should correspond with any description applied to them
ETA-I'm not trying to start a bun fight at all with you pink donut, just wanted to state my side too xx

All of the above is also in the website i posted.
tink none of that was aimed at you, was just trying to make things clear for people, posted it to help people understand things a bit better about other sides of refund/returning things so people actually know their rights and don't get turned away
Are you 'fast fashion' or 'capsule pieces'?
NO.2. ask :
Are you 'fast fashion' or 'capsule pieces'?
Are you into buying and ditching (by ditching I mean charity shops or just hoarding) known as 'fast fashion' which tends to be quite cheap (Primark HM) or are you into buying more expensive items (Designer or French Connection, Karen Millen etc) which you know will last you design wise and possibly quality wise longer.
Answer:
I tend to buy items that are a little more expensive and that I know will last. do buy the odd thing in primark but they tend to be items that i know will date quickly. I am a complete hoarder and I do have clothes that I have had for years that I stell wear. In fact I have one skirt that I have had for twenty years that I still wear and get complimented on.
Answer:
I usually always like to buy to last but that doesn't necessarily mean that I splash out on anything. Expensive for me these days is River Island Topshop!
I like a good mix of both really.
Answer:
Hmmmm
I typically don't buy something unless I intend to wear it a lot and it's quite unusual for me to go off something; I have clothes from 10 years ago that I still wear. So I don't think I'm in the first category. But since many of my clothes are cheap (charity shops, Primark, sales) I don't know that I'm in the second either.... :cmdunno:

I'm similar though I'll happily chuck in some quirky one season pieces from HM and the likes that are cheap and disposable, but mainly in the form of accessories, such as scarves or t-shirts. I will invest more in things like jeans or skirts as I like to be able to wear them for a few years, and spend more again on suits/work clothes as these tend to be in more classic styles anyway:wave:
Quick Question for Grazia Subscribers....
NO.3. ask :
Quick Question for Grazia Subscribers....
Has anyone else only been receiving their magazine through the post on Wednesdays instead of Tuesdays or it it just me??
This must be the 3rd maybe 4th week i've come home from work on a Tuesday only to find no mag to read!!!
Answer:
I had been getting mine on a Wednesday but recently have had it on a Tuesday. Just as I cancelled my subscription
What do you hink of this top
NO.4. ask :
What do you hink of this top
I want something in this style, and like the shape but I'm not sure about the detail.
Up close...
Any thoughts?
Answer:
Its ok, I've decided to go for a plain one.
Answer:
I quite like that actually x
Answer:
I really like it!

Answer:
It looks ok, like the style as something different... but not too sure of those studs and if they would cheapen the look of the top rather than add nice detail... would have to see IRL, but seeing studded tops like those before I am not too keen on them.
HM Skinny Trousers
NO.5. ask :
HM Skinny Trousers
I cannot rave about these enough. They come up quite small and are even good for shorter legged ladies as the look cool over heels or ruched up. And at £14.99 and a range of colours you can't go wrong. I have them in a very dark grey, almost black. And now they do a slightly thinner material with a ruched lower leg that looks fab on, although seems to run a bit bigger, but are only £7.99.
Answer:
Sounds interesting, but don't know if they would be any good for my short chubbo legs though!
I was just thinking this morning I would like some straight legged trousers... need to be a bit more interesting than my cop-out plain black bootleg troos!
Answer:
I have a couple of pairs of these too - black and grey and they are good for the price and for anyone on the short side. I find it really difficult normally to find trousers that don't need taking up and these fit me perfectly (I'm 5ft4 ish).
Answer:
I am 5'7 but my legs are on the shortish side... Do they only come in one length? What are they like in the bum and do they have any pockets? Sorry for all the qu's!
Answer:
Are they called SQIN?
